1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ColorBreak ("Company," "we," "us," or "our") concerning your access to and use of the ColorBreak iOS application and browser extension (collectively, the "Services").

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to access or use the Services and should immediately discontinue use.

2. Description of Services

ColorBreak provides digital wellbeing tools designed to help users reduce screen time through intelligent grayscale technology. The Services include:

  • iOS application for system-wide grayscale control
  • Browser extensions for web-based grayscale control
  • Features including app exceptions, scheduling, location-based rules, and usage analytics
  • Optional premium features available through in-app purchases

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

3. Eligibility

You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws
  • If you are under 18, you have obtained parental or guardian consent

4. User Accounts and Registration

The Services do not require account creation for basic functionality. However, if you choose to create an account or use features requiring authentication:

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account

5. License and Restrictions

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Services for your personal, non-commercial use on devices you own or control.

5.2 Restrictions

You agree NOT to:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the Services
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use the Services for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Services
  • Use any automated means to access or scrape content from the Services
  • Distribute, sublicense, rent, lease, or loan the Services to third parties
  • Use the Services in any way that could damage, disable, or impair our servers or networks
  • Create derivative works based on the Services

6. Premium Features and Payments

6.1 In-App Purchases

Certain features require payment through in-app purchases ("Premium Features"). Payment processing is handled by Apple (for iOS) or respective browser extension stores.

6.2 Pricing

All prices are clearly displayed in the app or extension. Prices are subject to change with notice. Currency conversion rates may apply based on your location.

6.3 Subscriptions

Premium subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple account settings or browser extension settings.

6.4 Refunds

Refund policies are subject to Apple's App Store terms or respective browser extension store policies. Generally, we offer a 7-day money-back guarantee for new subscriptions. Contact us at support@colorbreak.app for refund requests.

6.5 Free Trials

Free trial periods may be offered for Premium Features. You will be charged after the trial period unless you cancel before it ends. You may only use one free trial per account.

7. Intellectual Property Rights

The Services, including all content, features, functionality, software, and design, are owned by ColorBreak and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The ColorBreak name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ColorBreak. You must not use such marks without our prior written permission.

8. User Conduct

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Services in any way that violates any applicable law or regulation
  • Impersonate or attempt to impersonate ColorBreak, our employees, or other users
  • Engage in any activity that interferes with or disrupts the Services
  • Use the Services to transmit any harmful code, viruses, or malware
  • Collect or harvest any information from the Services using automated means
  • Use the Services in any manner that could disable, overburden, or impair proper functioning

9. Third-Party Services and Links

The Services may contain links to third-party websites or services that are not owned or controlled by ColorBreak. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that ColorBreak shall not be responsible or liable for any damage or loss caused by or in connection with your use of any third-party content, goods, or services.

10. Disclaimers and Limitations of Liability

10.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

ColorBreak does not warrant that:

  • The Services will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Services are free of viruses or other harmful components
  • The results from using the Services will meet your requirements

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLORBREAK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Unauthorized access, use, or alteration of your content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless ColorBreak and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any harmful, fraudulent, or illegal activity

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use the Services will immediately cease
  • You must discontinue all use of the Services
  • Any data stored locally will remain on your device unless you delete it
  • Premium subscriptions will follow the refund policies outlined in Section 6

You may terminate your use at any time by uninstalling the app or extension and ceasing all use of the Services.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall be resolved through:

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms with a new "Last updated" date
  • Providing in-app notification of significant changes
  • Sending email notification (if you've provided an email address)

Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the Services.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original.

16. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ColorBreak regarding the Services and supersede all prior agreements and understandings, whether written or oral.

19. Apple-Specific Terms (iOS App)

If you access the Services through an iOS device:

  • These Terms are between you and ColorBreak only, not with Apple Inc.
  • Apple has no obligation to furnish maintenance and support services
  • Apple is not responsible for addressing any claims relating to the app
  • Apple is a third-party beneficiary of these Terms and may enforce them
  • You must comply with applicable third-party terms when using the app
